The difference is especially highlighted by New York laws such as the Sex Offender Registration Act (“SORA”) and the March 14, 2007 enactment of the Sex Offender Management and Treatment Act (“SOMTA”), which can result in a defendant being civilly confined beyond the time served for a prison sentence. A related federal statutory law has also been recently enacted, entitled the Sex Offender Registration and Notification Act (“SORNA”), more informally known as the Adam Walsh Act. It is important for anyone charged with a sexual offense to have counsel who understands these statutes and can advance an aggressive defense in response to them. The same holds true regarding a new section of the law that considers whether a felony is “sexually motivated.” Under this statute, non-sexual offenses may become sex offenses if deemed sexually motivated.
